Abstract

Ideja thelbësore e sistemit juridik, e njohur gjithashtu si Shteti i së Drejtës, qëndron si një element kryesor në demokracitë kushtetuese bashkëkohore. Studimi aktual synon të argumentojë kufijtë dhe dispozitat e ndërvarësisë ndërmjet të drejtave dhe lirive themelore dhe rolit të Gjykatës në shpërndarjen e kufijve të lirive. Metoda e përdorur në këtë artikull është hermeneutike, krahasuese dhe e studimit të rastit. Objektivi i kësaj trajtese është të shqyrtojë kuadrin ligjor të të drejtave të njeriut dhe dispozitat e tyre kufizuese në të drejtën evropiane dhe në Shqipëri. Rezultatet cilësore nga hulumtimi hermeuneutik dhe krahasues tregojnë se parashtrimi i thelluar i të drejtave nuk është vetëm një krahasim i vlerave morale dhe këndvështrimeve të ndryshme për të drejtat e njeriut, të cilat janë shfaqur si alternativa më kuptimplota në kohën tonë. Ky konfrontim na përfshin në botën komplekse dhe të paqëndrueshme të politikave bashkëkohore të të drejtave të njeriut dhe të ruajtjes së tyre. Njohja e rëndësisë së tyre dhe marrja e masave për t’i mbështetur drejtpërdrejt kontribuojnë në zgjidhjen dhe balancimin e drejtë të çështjeve në sistemin gjyqësor dhe në pasurimin e përbashkët të shoqërisë.
