The Protected Witness and the Value of his Testimony in Criminal Process of RM
Abstract
During the last decade the interest of the authors of criminal law as well as of competent state authorities regarding the protection of witnesses is extremely large. In this regard, a number of states have issued special laws, such as Macedonia, whose government devoted a special program to protect witnesses. On May 26, 2005, the Assembly of the Republic of Macedonia issued a law titled The law for the protection of witnesses, issued in an "Official Journal", with no. 38/05.
There is no doubt that the protection of witnesses is a very sensitive issue in terms of justice in general and in especially of criminal justice. The reasoning consists in the fact that witnesses almost in all the cases do not allow the truth to be revealed in a court case, and especially in serious cases. The purpose of witness protection is the assurance of his / her testimony in the judicial proceeding, in order to find the truth which will enable the punishment of the criminal offense author. We can say that the protection of the witnesses is intended to prevent him / her from having any risk from the authors of criminal offense after they have given their testimony.
